ADA Coordinator Information
Title II of the Americans with Disabilities Act of 1990 ("ADA") requires all state or local government entities with 50 or more employees to appoint a responsible person to coordinate the administrative requirements of ADA compliance and to respond to complaints filed by the public. The name and contact information for the responsible person is required to be publicly advertised.
The drafters of the ADA modeled this position after the 504 Coordinator that had been required under the Rehabilitation Act. Responsibilities of ADA Coordinators include:
- Conducting a self-evaluation and developing the transition plan.
- Monitoring the implementation of the transition plan.
- Handling requests for auxiliary aides and services.
- Providing information about accessible programs and services.
- Serving as an ADA resource.
- Receiving and working to resolve complaints.
- Working with officials and administrators to ensure new facilities or alterations are accessible.
The City of Branson, as a local government, is required by the ADA to perform a self-evaluation of all policies, programs, and facilities. The first city-wide Self-Evaluation was completed in 2000. A second and partial self-evaluation was completed by the Parks and Recreation Department of all of its parks and facilities in 2011. The ADA Transition Plan is a document that describes the City of Branson’s actions to provide equal accessibility to programs, services, and facilities for those with disabilities, in compliance with 23 CFR 200.7 28 CFR 35, 49 CFR 27 and 49 CFR 37, and other applicable regulations and authorities. It is intended to be a living document, updated annually to reflect the current state of the Department’s Americans with Disabilities Act (ADA) and Section 504 Accessibility program. The City of Branson is currently in the process of developing its ADA Transition Plan.
This Grievance Procedure is established to meet the requirements of the ADA. It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits by the City of Branson. The City's Personnel Policy governs employment-related complaints of disability discrimination.
The complaint should be in writing and contain information about the alleged discrimination such as name, address, phone number of complainant and location, date, and description of the problem. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint, will be made available for persons with disabilities upon request.
The complaint should be submitted by the grievant and/or his designee as soon as possible but no later than 60 calendar days after the alleged violation to the City of Branson ADA Coordinator.
Within 15 calendar days after receipt of the complaint, the ADA Coordinator or his designee will contact the complainant to discuss the complaint and the possible resolutions. Within 15 calendar days of contact, the ADA Coordinator or his designee will respond in writing, and where appropriate, in a format accessible to the complainant, such as large print, or audio tape. The response will explain the position of the City of Branson and offer options for substantive resolution of the complaint.
If the response by the ADA Coordinator or his designee does not satisfactorily resolve the issue, the complainant and/or his designee may appeal the decision within 15 calendar days after receipt of the response to the Director of Public Works/Engineering or his designee.
Within 15 calendar days after receipt of the appeal, the Director of Public Works/Engineering or his designee will contact the complainant to discuss the complaint and possible resolutions. Within 15 calendar days after the meeting, the Director of Public Works/Engineering or his designee will respond in writing, and, where appropriate, in a format accessible to the complainant, with a final resolution of the complaint.
All written complaints received by the ADA Coordinator or his designee, appeals to the Director of Public Works/Engineering or his designee, and responses from these two offices will be retained by the City of Branson for at least three years.
